Terms of Service
These Terms of Service ("Terms") govern your use of the Hesed Leads platform ("Service") operated by Hesed Leads ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
Hesed Leads is a lead generation platform that connects home care agencies with caregiver candidates (CNAs, HHAs, home health aides, and caregivers) who have expressed interest in employment opportunities. We are not an employment agency, staffing firm, or recruiter and do not guarantee the qualifications, availability, or employability of any lead.
2. Eligibility
You must be a licensed home care agency, home health agency, hospice provider, or senior living community to use this Service. By creating an account, you represent that you are authorized to enter into these Terms on behalf of your organization.
3. Pricing
Leads are priced at $10 per lead delivered to your account. Pricing is subject to change with 14 days' written notice.
4. Free Trial
New agencies receive 5 free leads upon signup. A valid payment method is required at signup via Stripe. Free trial leads are subject to all other Terms, including acceptable use requirements. The free trial is available once per agency.
5. Billing and Payment
- A valid credit or debit card is required at signup and stored securely via Stripe
- Billing occurs weekly for all leads delivered during the preceding billing period
- Invoices are automatically charged to your card on file
- Failed payments may result in account suspension until the balance is resolved
6. Pausing and Cancellation
You may pause or cancel your account at any time from your dashboard or by emailing us. There are no cancellation penalties or long-term commitments. Pausing stops new lead delivery; resuming re-activates it immediately. You remain responsible for payment of all leads delivered prior to pausing or cancellation.
7. Lead Quality
We deliver contact information (name, phone, email) for caregiver candidates who have expressed interest in employment opportunities through Meta Lead Ads. We do not guarantee:
- That any lead will result in a hire
- The accuracy or completeness of candidate-provided information
- Response rates or candidate engagement levels
- Any specific credential, certification, or qualification of any lead
Leads are delivered "as is." You are solely responsible for screening, verifying, and making all hiring decisions.
8. Exclusivity
Each lead is delivered to one agency only based on ZIP code matching. We do not sell the same lead to multiple agencies.
9. Acceptable Use
You agree not to:
- Resell, redistribute, or share lead data with third parties
- Use lead contact information to send unsolicited bulk communications (spam)
- Contact leads more than a reasonable number of times if they do not respond
- Use the Service for any unlawful purpose or in violation of applicable employment laws
- Attempt unauthorized access to the Service or other agencies' data
Violation of acceptable use may result in immediate account termination without refund.
10. Limitation of Liability
To the maximum extent permitted by law, Hesed Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of business opportunities, arising out of or related to your use of the Service.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total amount you paid us in the three (3) months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Hesed Leads and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
12. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated by email to active account holders. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Boulder County, Colorado.
